Almost certain to appear: Real Property Community Property Will and/or Trusts The only two that are, given historical frequency rates, most certain to appear: Real Property (never been skipped more than two consecutive administrations) and Community Property (never been skipped more than three consecutive administrations). And I DOUBT Civ pro is going to appear since it was tested Feb '09 and as a crossover in two questions in July '09. Caveat: the first time I took the Bar exam, Barbri (Sakai) erred in 4 out of 6 essay predictions.

Be careful on relying on such prognostications. They rarely work. For
example - PR has been, with one exception (July 07), on all of the last
seven exams at least, once sometimes more (i.e. crossovers). There is a
very good chance that PR will be on the coming exam as well.

I think we'll see Contracts, Real Property, Prof. Res., Wills/Com Property cross over, Corp. and either ConLaw or Criminal law.


I would almost bet a 100 bucks that we'll see five of those six.

And i would almost bet a 100 bucks we won't see Civ Pro and Torts.

If you look at the history of Torts, it's the least "dropped" subject.

If it doesn't show on the Essays, it shows on Performance.

And Defamation was tested last year for the bar and July for performance.


Torts, one way or another, is nearly as tested as PR.

I wouldn't rule out CA civ pro distintions, agencies and business associations. I think they have a good chance because they haven't been tested yet.

February tends to be a weird exam which appear to ask California specific subjects hard versus July which tends to be very straight forward without playing hide the ball.

Agency and partnership was tested in Feb 08 though someone earlier in the string said it wasn't. The call in that essay didn't specify partnership, agency, etc., but to do well on the corp essay, you had to discuss them to get to liability issues of an improperly formed corporation.

Barbri ends tomorrow (the 12th) I believe. We'll see what they have to say about the Feb '10 exam.

i believe  in predictions
i am riding EVERYTHING BUT
i will concentrate in reading every available essay in reference to the predictions.
Anyway I think we will have definately Evidence, you know those question answer type  narative non responsive (God help), contracts or Corporations cross with civ procedure, crim law with cross constitutional , real property with  covenants , definately prof responsibily and last but not least wills with cross trusts or trust cross with wills with trustee duties violation
